How a single sentence rewired SoundCloud’s rules

Scroll to Section 6.2 of the new TOS and you’ll find it. Short, sharp, decisive. That lone sentence flips the default from “ask first” to “we’ll scrape unless otherwise stated.” SoundCloud insists that any AI use remains internal think recommendation tweaks, fraud filters, and better playlist curation not “full‑fat” model training. Critics counter that the language is so roomy you could drive a tour bus (plus a couple of server racks) through it. 

The digital detective who blew the whistle

Tech ethicist and composer Ed Newton‑Rex spotted the change, then posted receipts from the Wayback Machine to prove the clause didn’t exist before. His X (formerly Twitter) thread went viral on May 9 2025 and sparked headline after headline. Newton‑Rex’s core gripe? Consent should be opt‑in, not buried. “Major questions to answer,” he wrote, summing up the collective side‑eye of thousands of indie artists.

SoundCloud’s official defense: trust us, it’s just recommendations

SoundCloud did fire back politely. In nearly identical statements to TechCrunch, Futurism, and What’s Trending, the company swore it has “never used artist content to train AI models” and “implemented a ‘no AI’ tag” to block third‑party scraping. AI, they say, only helps with fraud detection, content identification, and smarter song suggestions. Future AI projects, they promise, will be “artist‑first.” Skeptics hear: “We haven’t … yet.” 

Artists push back: we gave you songs, not training data

The backlash is loud and lyrical. Some creators yanked tracks, others vowed to quit the platform outright. Indie duo The Flight nuked their catalog and posted a curt “Ok then…” farewell. Composer Adam Humphreys followed suit. The worry? Generative models trained on their work could one day crank out AI songs that compete with or replace them, royalty‑free. 

Labels stay calm contracts act as shields

Major labels such as Universal Music Group and Warner Music Group enjoy separate, lawyer‑forged agreements. Those deals trump the new clause, walling off superstar catalogs from the data buffet. For independent uploaders, no such shield exists. In other words: Beyoncé sleeps easy; bedroom producers do not. 

The opt‑out puzzle: can creators escape?

The pattern is clear: announce nothing, wait for a watchdog to notice, issue a calming statement, keep moving. The result? A slow shift of creative control from humans to hyperscale GPUs. 

Why is AI so hungry for beats anyway?

Training high‑fidelity music models demands oceans of labeled audio. Platforms like SoundCloud own exactly that: millions of tracks spanning every micro‑genre from cloud rap to Lithuanian jazz‑trance. Feeding such diverse data into generative systems can birth shockingly versatile models ones that spit out custom soundtracks, jingles, or entire albums in a click. No wonder the silicon wants your synth lines. 

Ethical fault lines: consent, credit, cash

Using someone’s song as raw material feels benign until that model starts selling mixtapes. Without explicit consent and compensation frameworks, AI can flatten centuries‑old norms of provenance. Artists risk becoming the ghostwriters of the algorithmic age, unpaid and uncredited. Lawmakers are only now sketching guardrails, but litigation (and lobbying) is already humming in the background track. 

A roadmap for transparent AI in music

Meaningful transparency starts with plain‑English summaries and default opt‑outs. Next, real‑time dashboards: which models touched my track, what outputs resulted, how much revenue did they generate? Finally, revenue sharing that’s as automated as the AI itself. Blockchain gospels claim to solve this; old‑school licensing might work too. Whichever path wins, openness beats opacity every time. (No citation this is forward‑looking analysis.)

What creators can do right now

  1. Read the TOS—you’ll hate it, but do it.
  2. Watermark or fingerprint your music. Some forensics tools can prove AI misuse later.
  3. Tag tracks “no AI” in their metadata; it’s not bulletproof, yet it signals intent.
  4. Join advocacy orgs like Fairly Trained—they lobby for consent‑first standards.
  5. Diversify platforms. Bandcamp, Patreon, and direct‑to‑fan sales dilute reliance on any single gatekeeper.

Practical? Yes. Fun? Not so much. Welcome to the admin side of creativity.

The takeaway: music’s future is up for negotiation

SoundCloud’s quiet clause is a test balloon for the entire creator economy. Let it float uncontested, and AI firms will assume the sky’s clear. Pop it through collective pressure, policy, or court order and platforms may finally ask before they harvest. The next chapter isn’t written yet. Musicians still hold pens, guitars, and crucially passwords to their upload pages. Stay noisy.
