Meta Snubs the EU’s AI Guidelines: A Tech Giant’s Stand Against European Regulation

Published on July 10th, this voluntary framework serves as a bridge between current AI development practices and the stricter requirements that will come into force on August 2nd under the EU’s landmark AI Act.

The code covers three critical areas that have become flashpoints in the AI regulation debate. First, transparency requirements demand that companies provide detailed documentation about their AI training processes. Second, copyright protections explicitly ban developers from training AI systems on pirated content. Third, security measures require companies to implement robust safeguards against potential misuse of their AI models.

Companies that sign the agreement receive what the EU calls “reduced administrative burden and increased legal certainty.” In practical terms, this means less regulatory scrutiny and clearer guidelines for compliance. It’s essentially a regulatory carrot designed to encourage voluntary adoption of best practices before mandatory rules kick in.

Meta’s Concerns Run Deep

Meta’s rejection isn’t based on a simple disagreement with specific provisions. The company has raised fundamental concerns about the code’s scope and implementation. According to Kaplan, the guidelines “introduce a number of legal uncertainties for model developers” and include “measures which go far beyond the scope of the AI Act.”

The company fears that these regulations will “throttle the development and deployment of frontier AI models in Europe.” This concern extends beyond Meta’s own operations to the broader European AI ecosystem. Kaplan argues that the regulations will “stunt European companies looking to build businesses” on top of AI platforms.

More than 45 companies and organizations, including major players like Airbus, Mercedes-Benz, Philips, and ASML, have signed a letter urging the EU to postpone the AI Act’s implementation for two years. This coalition represents a significant portion of Europe’s tech and industrial base, suggesting that regulatory uncertainty extends far beyond social media companies.

While Meta stands firm in its opposition, the industry response has been mixed. Microsoft has taken a more cautious but ultimately supportive stance. Company President Brad Smith told Reuters that “it’s likely we will sign” the code of practice, though he emphasized the need to “read the documents” carefully first. Microsoft’s approach reflects a willingness to work within the European regulatory framework while maintaining some reservations about specific provisions.
